Municipal Law
A primary focus of our firm is representing municipalities.
All of our attorneys have substantial and diverse experience
serving municipalities in connection with the entire range of
issues they encounter, such as zoning, subdivision and land development,
risk management, open space and historic preservation, condemnation,
general liability protection, police and civil service, sewage
disposal, and environmental regulatory compliance.
We are committed to position our municipal clients at the
forefront of all available planning and risk management strategies.
We monitor developments in the Pennsylvania legislature and
decisions from Pennsylvania courts that affect municipalities,
and recommend appropriate courses of action at both the state
and local levels. For example, our firm has actively assisted
our clients in coming into compliance with the M4 requirements
of EPA by preparing Stormwater Ordinances that meet or exceed
the Bucks County Model Ordinance’s requirements for stormwater
facilities and implement Best Management Practices.
We are effective litigators. Our firm has successfully prosecuted
matters through the Pennsylvania Supreme Court with landmark
decisions in two important cases. In addition, we have successfully
represented our municipal clients in proceedings before the
Environmental Hearing Board, the Public Utilities Commission
and before other administrative bodies. From irradiators to
show clubs to requiring property owners to remove hazardous
conditions, we have been at the center of practically every
legal issue faced by municipalities.
Our firm offers a “team” approach, with a designated
primary contact to attend municipal meetings. Our attorneys
devoted to serving our municipal clients are Terry W. Clemons,
and Scott A. MacNair.
Scott is the newest addition to our firm. Having worked in
the Bucks County District Attorney’s office for five
years, he brings the finely honed skills of a litigator to
our practice. Stefan Richter also engages in litigation matters,
and handles our homeowner and condominium association clients.
He is always available to service our municipal clients on
matters of special concern or when the work demands dictate.
Peter Reiss specializes in tax matters and assists our municipal
clients with bond and other borrowing issues, as well as other
matters having tax implications.
